Terms of Service

1. Acceptance of Terms

By accessing or using the FranksRooms platform — including our website, mobile applications, and any related services — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform. Your continued use of FranksRooms after any modifications to these terms constitutes acceptance of those changes. We reserve the right to update these terms at any time, and we will notify registered users of material changes via email or an in-app notification.

2. Eligibility & Accounts

You must be at least 18 years of age to create an account on FranksRooms. All users are required to complete phone verification during the registration process before they can list a space or submit a booking request. Each individual is limited to one account — creating multiple accounts to circumvent restrictions, bans, or platform rules is strictly prohibited and will result in immediate termination of all associated accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, you must notify us immediately at frank@franksrooms.com.

3. Listings

All listings must include a minimum of three photographs that accurately represent the space being offered. Listers are required to attest that they have the legal right to sublet the property, whether through landlord permission, lease provisions, or applicable local law. FranksRooms reserves the right to remove listings that contain misleading information, stock imagery, or photos that do not match the actual space. All listing content is subject to automated and manual content filtering to ensure compliance with our policies. We may request additional documentation to verify sublet authorization at any time.

4. Booking & Stays

FranksRooms is designed for long-term subletting. All bookings require a minimum stay of one month. Bookings may be structured as fixed-term agreements (with a defined start and end date) or as month-to-month arrangements that renew automatically. For month-to-month stays, either the lister or the renter may terminate the arrangement by providing at least 30 days' written notice through the platform. Early termination of a fixed-term booking may be subject to penalties as outlined in the specific listing agreement. Both parties are encouraged to communicate any changes or issues through the FranksRooms messaging system to ensure a documented record.

5. Payments

All rental payments are processed through the FranksRooms platform. Our primary payment method is ACH bank transfer; if ACH is unavailable or fails, the platform will fall back to debit card processing. Recurring monthly payments are due on the 1st of each month, with a 3-day grace period through the 3rd. Payments not received by the end of the grace period may incur late fees as specified in the listing agreement. For the first month of a new booking, rent is prorated from the date of acceptance — you only pay for the days you actually occupy the space. All amounts are displayed in US dollars.

6. Platform Commission & Fees

FranksRooms charges a 15% platform commission on each rental payment. This commission covers payment processing, dispute mediation, customer support, and ongoing platform development. ACH transaction fees incurred by the payment processor are passed through to the renter at cost and will appear as a separate line item on payment receipts. Debit card processing fees are absorbed by FranksRooms and are not charged to either party. The commission rate may be updated with 30 days' advance notice to all active users.

7. Deposits

Listers may require a security deposit as part of their listing terms. The deposit amount is set by the lister and is clearly displayed on the listing page before a renter submits a booking request. Deposits are held by FranksRooms in a designated account for the duration of the stay. Upon the conclusion of a booking, the lister has 14 days to submit any claims against the deposit with supporting documentation (photographs, receipts, or written descriptions of damages). If no claim is filed within that 14-day window, the full deposit is automatically refunded to the renter. Partial claims result in the undisputed portion being refunded immediately, with the contested amount held pending resolution.

8. Payouts

Lister payouts follow a schedule designed to protect both parties. For the first month of a new booking, the payout is released to the lister once the renter confirms move-in through the platform. If the renter does not confirm within 72 hours of the scheduled move-in date, the payout is automatically released. For the second month onward, funds become available to the lister on the date the renter's payment clears, plus a 24-hour processing window. Payouts are delivered via the lister's connected bank account. FranksRooms is not responsible for delays caused by the lister's financial institution.

9. Content Policy

To protect the safety and privacy of our community, users may not include personal contact information in any public-facing content on the platform. This includes phone numbers, email addresses, Social Security numbers, external website links, and social media handles. Our automated systems scan listing descriptions, profile bios, and messages for prohibited content. Attempts to obfuscate contact information — such as spelling out digits, using creative formatting, or embedding details in images — are logged and may result in content removal, account warnings, or suspension. All communication between renters and listers should occur through the FranksRooms messaging system.

10. Disputes

In the event of a dispute between a renter and a lister, FranksRooms provides a platform-mediated resolution process. Either party may initiate a dispute through their dashboard. Upon filing, relevant payouts and deposit funds are frozen until the matter is resolved. Both parties will be given the opportunity to submit evidence and statements. A FranksRooms administrator will review the case and issue a binding decision. We aim to resolve all disputes within 14 business days, though complex cases may require additional time. The platform's decision is final with respect to the release of any held funds.

11. Community Guidelines

FranksRooms is built on trust and mutual respect. All users maintain public profiles that are visible to other community members. You agree to conduct yourself respectfully in all interactions on the platform, including messages, reviews, and any in-person meetings related to a booking. Discriminatory behavior based on race, gender, sexual orientation, religion, national origin, disability, or any other protected characteristic is strictly prohibited. We encourage honest, constructive feedback and expect all users to treat one another as they would a good neighbor.

12. Prohibited Conduct

The following activities are strictly prohibited on FranksRooms: submitting fraudulent listings or booking requests; providing false identity information or documentation; harassing, threatening, or intimidating other users; attempting to circumvent the platform to arrange payments or bookings off-platform; creating multiple accounts to evade enforcement actions; manipulating reviews or ratings; using the platform for any unlawful purpose; and scraping, crawling, or otherwise extracting data from the platform without written authorization. Violations may result in immediate account suspension or permanent ban, at our sole discretion.

13. Limitation of Liability

FranksRooms operates as a marketplace platform that connects listers with renters. We do not own, manage, or control any listed properties. We are not a party to any rental agreement between users and do not guarantee the condition, legality, or suitability of any listing. To the maximum extent permitted by applicable law, FranksRooms shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to property damage, personal injury, or financial loss. Our total liability for any claim related to the platform shall not exceed the amount of fees you have paid to FranksRooms in the 12 months preceding the claim.

14. Termination

FranksRooms reserves the right to suspend or permanently ban any user account that violates these Terms of Service, our Community Guidelines, or any applicable law. Suspension may be temporary (pending investigation) or permanent (following a confirmed violation). In the event of termination, any active bookings will be handled on a case-by-case basis to minimize disruption to the non-violating party. Funds held in escrow will be disbursed according to the platform's dispute resolution process. You may also voluntarily deactivate your account at any time through your account settings, subject to the completion of any outstanding bookings or financial obligations.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law provisions. Any legal action or proceeding arising out of or relating to these terms or your use of the FranksRooms platform shall be brought exclusively in the state or federal courts located in the County of New York, New York. By using the platform, you consent to the personal jurisdiction and venue of these courts.
